These Terms & Conditions ("Terms") govern your use of getmendis.com.au ("Get Me NDIS", "the site"), operated by We Are Care (ABN 46 684 051 474) ("we", "us"). By using the site, including the eligibility check, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the site.
1. What this service is — and is not
- Get Me NDIS provides a free, general, indicative guide to whether a person may meet the publicly available access criteria for the National Disability Insurance Scheme (NDIS).
- The check is not an application, not an assessment, not advice (medical, legal, financial or otherwise), and not an eligibility decision.
- Only the National Disability Insurance Agency (NDIA) can decide access to the NDIS. A positive indication from this check does not mean, and must not be relied on as meaning, that you will be granted NDIS access. A less-positive indication does not mean you will be refused.
- We are not the NDIS, not the NDIA, and not a government agency, and we are not affiliated with or endorsed by them. "NDIS" is used descriptively to refer to the scheme.
2. The check is a lead-generation service
The check is provided free of charge by We Are Care, a registered NDIS provider. In exchange, you provide your contact details and consent for We Are Care to contact you about your result and support options. Providing accurate contact details is a condition of using the check.
3. Your responsibilities
- You will provide information that is true and accurate to the best of your knowledge.
- If you complete the check for another person, you confirm you are authorised to provide their information and to be contacted about them.
- You are responsible for any decision you make after using the site, including whether and how to apply to the NDIS. We recommend seeking advice from qualified professionals and consulting official NDIS resources at ndis.gov.au.
4. Accuracy of information
We take reasonable care to base the check on publicly available NDIS access criteria and to keep content current, but the NDIS and its rules change and we do not warrant that site content is complete, current or error-free at all times.
5. Liability
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Competition and Consumer Act 2010 (Cth) or other law that cannot lawfully be excluded. Subject to that: the site and check are provided "as is"; we exclude all other warranties; and to the maximum extent permitted by law, we are not liable for any loss or damage (including indirect or consequential loss) arising from your use of, or reliance on, the site or any result it produces. Where liability cannot be excluded but can be limited, our liability is limited to resupplying the service.
6. Intellectual property
The site's content, design and check flow are owned by or licensed to We Are Care. You may not copy, reproduce or commercially exploit them without written permission.
7. Acceptable use
You must not misuse the site, including submitting false or misleading information, attempting to interfere with its operation, or using it for any unlawful purpose.
8. Changes
We may update the site and these Terms from time to time. The version published on this page applies at the time you use the site.
9. Governing law
These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of its courts.
